NY Penal Law 155.40 / 155.42 - Grand Larceny

Deed theft is prosecuted as Grand Larceny under New York Penal Law. Second Degree (PL 155.40) is a Class C felony, up to 15 years. First Degree (PL 155.42) applies when victims are elderly or disabled, or when three or more properties are stolen, and is a Class B felony carrying up to 25 years.

Real Property Law 265-a

Enacted in 2024, this law specifically targets deed theft with enhanced criminal penalties and grants the NY Attorney General original criminal jurisdiction to investigate and prosecute deed theft cases statewide.

Right to Stay in Your Home

Even if a fraudulent deed has been filed, you have the legal right to remain in your home while the case is resolved. Do not let anyone intimidate you into leaving.
